RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT
(The 3-D world stuff…)

April 25, 2026 Day Workshop/Retreat

This Release of Liability, Assumption of Risk, and Indemnification Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Heart-Forward, a California 501(c)(3) corporation, its directors, officers, employees, volunteers, contractors, facilitators, agents, representatives, successors, assigns, and the owner/operator of the event venue (collectively, “Released Parties”).

1. Acknowledgment of Activities

Participant understands that the April 25, 2026 Heart-Forward Day Retreat (the “Event”) may include, but is not limited to:

  • Sound bath experience

  • Reiki energy session

  • Guided meditation

  • Breathwork

  • Intuitive readings

  • Journaling

  • Group discussions

  • Light physical movement

  • Rest and reflective practices

  • Food and beverage service

Participant understands these activities may involve emotional, mental, or physical responses and that in approximately 20% of sessions, the release of trapped emotion(s) or other energy(s) may result in “processing” where echoes of the emotion(s) or other energy(s) released may manifest in temporary physical or emotional discomfort, and that this “processing” appears to be a normal part of regaining energetic balance.

2. Assumption of Risk

Participant voluntarily elects to participate and understands that participation may involve inherent risks including, but not limited to:

  • Emotional release

  • Dizziness or lightheadedness

  • Physical discomfort

  • Aggravation of pre-existing medical conditions

  • Allergic reactions

Participant knowingly and freely assumes all such risks, both known and unknown, even if arising from the negligence of the Released Parties, except as prohibited by California law.

3. Not Medical or Psychological Treatment

Participant acknowledges that Reiki, sound healing, meditation, Emotion Code and related wellness practices:

  • Are complementary wellness modalities

  • Are not medical, psychological, or psychiatric treatment

  • Are not substitutes for licensed healthcare

Participant affirms that information is offered as a service and is not meant to replace any medical treatment. Participant is responsible for consulting a physician or qualified healthcare provider regarding any medical condition prior to participation and before making any decisions about their health. Information received is not intended to create any physician-patient relationship, nor should it be considered a replacement for consultation with a healthcare provider, nor is it meant to replace any medical treatments as ordered by any physicians nor any other medical care that has been advised by them. 

Participant affirms they are physically and mentally capable of participating. These methods are not a replacement for any professional psycho-therapeutic or counselling sessions in the treatment of any mental health issues or disorders.

Any suggestions made by Released Parties regarding supplementation of any kind, such as vitamins, minerals, herbal preparations, or any compounds or any other external remedy of any kind, that Participant uses or ingests are at their own risk, with the recommendation to seek the advice of a physician before using any remedy suggested.

Released Parties make no claims as to healing or recovery from any illness anyone may have now or in the future, and that no guarantee is made towards validity. The participant understands that the use of any information received is at your own risk.

4. Release and Waiver of Liability

To the fullest extent permitted by California law, Participant hereby releases, waives, discharges, and covenants not to sue the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in the Event, including those arising from the ordinary negligence of the Released Parties.

This release does not apply to gross negligence, reckless misconduct, or intentional misconduct.

5. Indemnification

Participant agrees to indemnify and hold harmless the Released Parties from any claims, damages, or costs (including reasonable attorneys’ fees) arising out of Participant’s actions, behavior, or participation during the Event.

6. Emergency Medical Authorization

Participant authorizes Heart-Forward and its representatives to obtain emergency medical treatment if deemed necessary. Participant understands that they are solely responsible for any medical expenses incurred.

7. Food & Allergy Disclaimer

Participant acknowledges that food will be served and agrees to disclose any allergies or dietary restrictions. Participant assumes responsibility for any adverse reactions.

8. Photo & Media Release 

Participant grants Heart-Forward permission to photograph and/or record video during the Event and to use such media for promotional, educational, and nonprofit purposes without compensation. Participant may opt out by notifying organizers in writing prior to the Event.

9. Governing Law & Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

If any portion of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

10. Acknowledgment of Understanding

Participant acknowledges that:

  • They have read this Agreement carefully.

  • They understand its contents.

  • They understand they are giving up substantial legal rights.

  • They are signing freely and voluntarily.
